Legal Protection For Consumers In Guaranteeing Halal Products Through Halal Certification Of Slaughterhouses (Tph-U)

Abstract

Food products are a basic need for humans whose raw materials come from animal sources. Consumers' rights to consume food that is Hygenic and Halal and Thayyib. The obligation of Business Actors to produce in a Halal manner has been regulated in the Consumer Protection Act Article 8 letter f Juncto Food Law year 18 of 2012 article 67 explains that Food Safety is organized to keep food safe, hygienic, quality, nutritious and not contrary to religion, belief, and culture of society. Likewise in Law Number 33 of 2014 concerning Guarantees for Halal Products in article 19 it explains that animals used as product ingredients must be slaughtered in accordance with Islamic law and comply with animal welfare and veterinary public health principles. The need for food from fresh chicken and beef is increasing for samarinda. For chicken per day around 12,000 tons, while the need for beef 7300.78 tons per year. The amount of demand for meat must be proportional to the quality of ASUH (Safe, Healthy, Whole and Halal) meat produced by TPH-U. But in practice, TPH-U has not been able to produce ASUH meat. This is because the majority of business actors selling broiler chickens in East Kalimantan are still at the scale of Poultry Slaughterhouses (TPH-U) who do not yet have a Veterinary Control Number (NKV) certificate from the Livestock and Animal Husbandry Service. Halal certification from the Indonesian Ministry of Religion's Halal Product Assurance Organizing Agency (BPJPH), not yet. Ironically Samarinda City as the Capital of the Province only has 6 RPU/TPU owned by the private sector, 3 are Halal certified and 3 Poultry Slaughterhouses only have Veterinary Control Numbers (NKV). While Poultry Slaughtering Places (TPU-U) in Samarinda are estimated to be 350. For the Province of East Kalimantan, which already have slaughterhouses include Samarinda, North Penajam Paser, Balikpapan, Kutaikartanegara, Bontang, Berau, East Kutai, Paser while West Kutai and Mahakam Hulu Does Not Have a Poultry Slaughterhouse (RPH-U). Apart from Slaughterhouses/Poultry Slaughterhouses, slaughter of animals must receive special attention so that the slaughter is in accordance with the legal Shari'a so that consumers can consume food products made from ASUH (Safe, Healthy, Whole and Halal) meat. In East Kalimantan, there are only 12 certified Halal Slaughterhouses (Julaiha) in 150 TPH-U. The lack of slaughtermen who have the competence of Halal Slaughterers (JULAIHA) results in consumers not being protected to consume food products whose raw materials come from animals that meet ASUH (Safe, Healthy, Whole and Halal) in Halal and Thayyib Islamic law.
