Abstract

Islamic family jurisprudence pays great attention to children and has established numerous rulings to preserve their rights and protect them from abuse. This is very important since children by all standards are the weakest members of the family, and this may cause some people with not strong faith to take away their rights and abuse them. Hence it is also seen that children as with other areas within the family have been provided for many rights including the religious and psychological ones by Islamic family jurisprudence. Particularly these laws in Islamic Family Law are laid down to the Children´s best interest and care in terms of safeguarding children’s rights as well as the general welfare. These rulings are however relevant to the Maqasid  Sharia since they aim at protecting children’s rights and development by promoting welfare among children and withholding maltreatment so that they can enjoy life.

اهتمت أحكام فقه الأسرة الإسلامية بالطفل، وشرعت العديد من الأحكام من أحل المحافظة على حقوقه، وحمايته من الاعتداءات، خاصة أن الطفل هو الفرد الأضعف في الأسرة، مما يشجع بعض ضعاف الإيمان على سلب حقوقه والاعتداء عليه، ولذا نرى أن أحكام فقه الأسرة الإسلامية أقرت العديد من الحقوق للطفل، ومنها الحقوق الدينية والنفسية، ويظهر في أحكام فقه الأسرة الإسلامية تمتعها بخصائص راقية، من أجل المحافظة على حقوق الطفل ورعايته، ويظهر أنها أحكام متوافقة مع مقاصد الشريعة في المحافظة على حقوق الطفل، وذلك في جلب المصلحة للطفل ودرء المفسدة عنه، لكي يعيش الطفل في ظل السعادة.
